1 Online Banking User Agreement

Online Account Access
Online Account access allows you check balances, make transfers and download your transaction information from any computer with internet access, any time you want.

System Settings:

In order to provide you with the most secure online banking, we ask that you set your browser to accept cookies, and enable JavaScript. Without the proper settings, you will not be able to access your account information through Online Banking. The cookies used during your online banking session will not be permanently stored on your computer.

You will need a personal computer, access to the Internet and a browser that allows access to secure pages. You are responsible for the installation, maintenance and operation of your computer. Clearwater CU will not be responsible for any errors or failures of any telephone service, your computer, the Internet or any Internet service provider nor for interruptions of service due to maintenance, updates or repairs.

You may use your personal computer to access your accounts through the Internet. You agree to not access or attempt to access accounts on which you are not an authorized signer.

Security Information:

Our secure server supports 128-bit data encryption, we cannot guarantee the security of your information if you share your password with others. We strongly encourage you to change your password the first time you sign on to Online Banking, and then again every six months. If you think someone may have obtained your password, change it immediately. Use a number that is easily remembered but not obvious. Do not write it down in your wallet, on your membership card, on your computer, or any place else where that information could be seen or stolen. Again, the best security is to change your password frequently.

Be sure to end your session by closing your browser. This prevents anyone using the computer after you from accessing your account using the "Back" button.

Agreement and Disclosure:

This Agreement is the contract which covers all rights and responsibilities concerning the use of Online Banking, the home banking service offered to you by Clearwater Credit Union. In this Agreement, the word "you" and "yours" mean those who use the home banking service and any joint owners of accounts accessed under this Agreement. The words "we", "us" and "our" mean Clearwater Credit Union and the online Bill Payment service offered by Clearwater CU.

Services Provided:

At the present time, you may use Online Banking for the following services at no charge:

1. Transfer funds between your own accounts.
2. Transfer funds from your account to the account of another member.
3. Review account balance and transaction history.
4. Print a copy of your transaction history.
5. Request a withdrawal by check payable to primary account holder.
6. Online Bill Pay, provided you are paying bills with an eligible draft account.

At the present time, you may use Online Banking for the following services with a service charge:

1. Bill Pay, if used with draft account not eligible for free Bill Pay
2. Stop payment of a share draft prior to payment
3. Order checks

Transaction limitations:

Transfers from share savings and share money market accounts are limited by Federal regulation to a total of six (6) per month excluding lobby transactions. You may make an unlimited number of transfers from your share draft account, provided you have the available funds to do so.

Withdrawals from VIP Share accounts and from Share Certificates are not allowed through the Online Banking system.

Mortgage loan balance or availability information is not available on Online Banking.

Transactions requested through Online Banking will be posted immediately during business hours. During non-business hours, your transaction will be posted on the next business day.

Fees:

At the present time, Clearwater Credit Union assesses the following charges for these Online Banking services:

1. Bill Pay--free for members using an eligible draft account. (see Bill pay section below for other fees that may apply.)
2. Stop payment of a share draft prior to payment--$25
3. Request a copy of a share draft--$2
4. Stop payment to a Bill Pay merchant--$25

There are no monthly fees and no access fees to use Online Banking. (Exceptions noted above.) When requesting most fee services, Online Banking will show you the fee and ask you to confirm the request. Check orders are an exception; we will not charge a processing fee, but the style and quantity of checks will determine the cost of your checks. If you need the exact fee in advance, please contact a Financial Service Representative at any of our branches, or call (406) 523-3300. Future services may carry fees. Fees are published in our Account Disclosures and Fee Schedule.

Unauthorized Use:

The safekeeping of your password is your responsibility. You agree not to disclose your password to anyone who is not an authorized signer on your accounts. If you permit other persons to access your account via Online Banking or give them your password, you are authorizing any transactions they conduct or authorize on your accounts. This authorization continues until you notify us and specifically revoke the authorization. If you fail to maintain the security of your password, we may terminate your Online Banking services immediately.

If you believe anyone knows your password or has accessed your account without consent, telephone us immediately at 406-523-3300. Also immediately change your password.

If your statement shows unauthorized use, notify us at once in writing. If you do not notify us within 60 days after we sent the first statement on which the problem appears (60 days after transaction date if you do not receive paper statements), you may not get any of the lost money back after the 60 days.

Error Resolution:

In case of Errors or Questions about Your Online Transactions Contact Us immediately

We must receive written notice from you no later than sixty (60) days after we sent the first statement on which the problem appeared or sixty days (60) days after the transaction appeared on your electronic statement.
In your written notice, please include:

Your name and account number.
Date of the suspected error.
Dollar amount of the suspected error.
Description of the transaction you are unsure about. Please explain why you believe it is an error or why you need more information.
If you notify us by phone or in person, we require that you send us your complaint or question in writing within ten (10) business days. Otherwise, we may not credit your account.

We must investigate the error and report the results promptly within a certain period of time after we receive notification from you: within five (5) business days if the error is an alleged unauthorized transfer involving a VISA Checking (Debit) card point of sale (merchant) transaction; within twenty (20) business days if the error involves a VISA Checking (Debit) card point of sale transaction other than an alleged unauthorized transfer; within twenty (20) days if the transaction involved a foreign-initiated transfer; and within ten (10) business days for all other reported errors.

If we cannot complete our investigation within the above time frame, we may take up to 45 calendar days (90 days if the transfer involved a point of sale or foreign transaction) to complete our investigation. If we provisionally credit your account for the disputed amount within the time frame and advise you of the credit within two (2) business days of the crediting you will have full use of the provisionally credited funds during the remainder of the investigation.

If we determine an error did occur, we will correct the error including the crediting of any interest and refunding of any fees no later than one business day after the determination and notify you of the results within three business days. If we find no error has occurred, we will send you a written explanation within three (3) business days after we finish our investigation, and we will charge your account for any provisionally credited amounts. You may request copies of the documents we relied on to make the determination.

Disclosure of Account Information to Third Parties:

We will not disclose information relating to any transaction by electronic transfer or application thereof to any person or government entity except with your consent or under subpoena issued by a court of record. This does not prevent disclosure of such information:

to a duly authorized auditor or regulatory authority examining Clearwater Credit Union.
to a credit bureau or clearing house which administers transactions between financial institutions.
to a party to the transaction seeking information relating to a specific transaction.
under regulatory requirements of NCUA.
Electronic Statements:

With your "Green Draft" account, you must provide a valid email address to receive monthly online statement (e-statements) notifications.

Change in Terms:

The Credit Union reserves the right to change the terms and conditions of this agreement upon proper notice to you, as required by law.
